The right of petition to the European Parliament

This thesis focuses on the right of petition to the European Parliament. The aim of the thesis was to provide the basic information about this institute and introduce it as an effective and beneficial instrument contributing to democratic principles in the European Union. The paper is divided into five chapters, in which is described development of the right to petition, procedure for submitting a petition, activities of Committee on Petitions. Further the paper evaluates exercise of this right according to different factors and finally, it compares the role of the Committee on Petitions with the work of the European Ombudsman.

The aim of this thesis is to provide a detailed and comprehensive view of the work of the European Ombudsman, in particular with respect to the way in which his office can help businessmen and economic operators. The thesis shall verify the following three hypotheses: First, the work of the European Ombudsman is not limited to the application of soft law, but also includes legality review related to maladministration of EU bodies and institutions. The second hypothesis claims that out-of-court protection of rights of individuals provided by European Ombudsman may be, under certain circumstances, more effective than judicial protection. Third, the instruments of out-of-court dispute settlement introduced by EU law are so numerous and complicated that they do not enable businessmen and economic operators to find their way in a satisfactory manner. This fact is the reason for a high number of inadmissible complaints addressed to the European Ombudsman and it wastes his resources for investigating individual complaints and launching his own inititative enquiries.
Comparison of profile of the complainants before European ombudsman and claimants before the Tribunal

One of the rights of EU citizens is to complain before the European ombudsman or to claim before Tribunal. Both physical and legal persons can turn to these European institutions. There are formal and procedural differences in requirements for a claim or for a complaint. The aim of this thesis is to find out, if these requirements mean an obstacle in protecting their rights for some group of persons. I also test My hypothesis that poor persons turn to the European ombudsman, whearas wealthy persons turn to the Tribunal.

The aim of this thesis is explanation the role of European ombudsman. The first part of this thesis describes history and development of European ombudsman, including legal bases. In the second part it aims to activities of European ombudsman, and define ombudsman authority. In this part is also description of the European Code of Good Administrative Behaviour, one of the most important documents for ombudsman. The third part is focused on complaints, the most frequently complaints. In this part is for completeness add graphs and tables, for better idea. The last part describes the case of own- initiative inquiry, it is the case from year 2011. This case deals with human rights.

The aim of this thesis is to introduce the role of the European ombudsman by describing the history of this office and the legal bases defining its competences. It also defines his relationship towards the European citizens and towards the various institutions at the European level. This thesis is focused on the description of the mechanisms of inquiries of the European ombudsman and on the characterization of various fields of these inquiries and also on more detailed description of the initiation, progress and conditions necessary for the successful conclusion of the case. Finally, this thesis deals with a specific own-initiative inquiry closed in 2011 as a demonstration of the work and achievements of this institution. Mainly English primary and secondary sources are used in this thesis. The sources basically consist of the Treaties on the European Union, the European Ombudsman's annual report, his publications, various articles on this subject or other Internet sources.

This bachelor's thesis deals with the institution of European ombudsman. The paper focuses on general description and definition the office of ombudsman. Then it investigates briefly its historical development and typology. Further it carries out the analysis of the primary law of the European Union and other implementary regulations with the aim of summarizing legal basis of the European ombudsman. Last but not least it deals with the procedures including the election and end of the function, course of procedure and powers enumerate by law. Finally, the paper analyzes a specific case in order to show how the institution works. The sources of the thesis were particularly legal rules, both Czech and foreign literature and the actual website of European ombudsman. The aim of this thesis is clarify institution of European ombudsman with the accent to legal basis, procedure and method which we all are able to use.

The aim of the thesis was to disclose and assume the legal bases of the European ombudsman institution as well as to work out an analysis of its activities. In the practical part of the thesis I focused on a deep analysis of chosen cases that the European ombudsman solved and closed in the last five years. As regards the cases I analysed in particular the procedures the European ombudsman followed in order to come to a resolution, consequently I analysed the legal sources it based its final decisions on.
